Terms of Service
Please read these terms carefully before using our services.

1. Acceptance of Terms
By accessing or using the services provided by Inco Cargo ("Company," "we," "us," or "our"), including our website, freight forwarding, customs clearance, warehousing, and related logistics services, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services.
2. Services Overview
Inco Cargo provides global freight forwarding, customs brokerage, supply chain optimization, trade compliance consulting, and warehousing and distribution services. Our services are subject to applicable international trade laws, customs regulations, and transportation agreements.
We act as an intermediary between shippers and carriers and do not assume the role of a common carrier. Our responsibilities are limited to arranging transportation and related logistics services on your behalf.
3. Client Responsibilities
As a client of Inco Cargo, you agree to:
- Provide accurate and complete information regarding shipments, including descriptions, values, weights, and dimensions of goods.
- Ensure all goods comply with applicable export and import laws, regulations, and restrictions.
- Obtain all necessary licenses, permits, and documentation required for the transportation and clearance of goods.
- Properly package and label all goods in accordance with applicable transportation and safety standards.
- Pay all fees, charges, duties, and taxes associated with the services in a timely manner.
4. Quotations and Pricing
All quotations provided by Inco Cargo are estimates and are subject to change based on actual shipment details, carrier rate adjustments, fuel surcharges, currency fluctuations, and other applicable factors. Final charges will be based on actual services rendered and may differ from initial estimates.
Quoted rates are valid for 30 days from the date of issuance unless otherwise specified. We reserve the right to adjust pricing with reasonable notice.
5. Payment Terms
Payment is due within the timeframe specified on the invoice, typically within 30 days of the invoice date. Late payments may be subject to interest charges at a rate of 1.5% per month. We reserve the right to withhold or delay services if there are outstanding unpaid balances on your account.
6. Limitation of Liability
Inco Cargo's liability for loss, damage, or delay of goods shall be limited to the lesser of the actual value of the goods or the limits set by applicable international conventions, including but not limited to the Montreal Convention, the Hague-Visby Rules, and the CMR Convention.
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, business interruption, or loss of data, arising out of or in connection with our services.
7. Insurance
We strongly recommend that clients obtain adequate cargo insurance for all shipments. Inco Cargo can assist in arranging cargo insurance upon request. Unless specifically agreed upon in writing, Inco Cargo does not provide insurance coverage for goods in transit or in storage.
8. Customs and Regulatory Compliance
While Inco Cargo will exercise reasonable care in handling customs declarations and regulatory filings, the client remains ultimately responsible for the accuracy of all information provided and for compliance with all applicable laws and regulations. Any fines, penalties, or costs arising from inaccurate or incomplete information provided by the client shall be the client's responsibility.
9. Force Majeure
Inco Cargo shall not be held liable for any failure or delay in performing its obligations due to events beyond its reasonable control, including but not limited to natural disasters, pandemics, war, terrorism, government actions, labor disputes, carrier failures, or disruptions to transportation infrastructure.
10. Prohibited Goods
Clients are prohibited from shipping goods that are illegal, hazardous (unless pre-approved), or restricted under applicable laws and regulations. Inco Cargo reserves the right to refuse, return, or dispose of any prohibited goods at the client's expense.
11. Termination
Either party may terminate the service agreement with 30 days' written notice. Termination does not relieve the client of the obligation to pay for services already rendered. Inco Cargo may immediately suspend or terminate services if the client breaches these terms or fails to make timely payments.
12. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of British Columbia, Canada.
13. Changes to Terms
We reserve the right to update or modify these Terms of Service at any time. Changes will be effective upon posting on our website. Continued use of our services after any modifications constitutes acceptance of the revised terms.
